- General provisions
- Booking of services occurs on the basis of the contracts concluded by Open Company BookingService with the enterprises of a hotel complex.
- Hotel room reservation is made on the basis of rules and conditions defined by corresponding hotel.
- All costs include the value-added tax.
- The costs specified on a web-site are valid for individual tourists.
- The order of services
- The order of service is carried out on the basis of the Form of the application properly filled and sent by the client on booking, and also on the basis of the application received by phone, e-mail or other accessible way of communication.
- Preliminary acknowledgement of the booking, in the way specified in the form of the application, the operator in time, for the working days, not later than carries out 24 hours after reception of the application.
The applications sent in target and official holidays, are served by the operator in the first the subsequent for days off the working day. - In unusual cases of JSC "BookingService" reserves the right to itself replacements of preliminary reserved hotel by hotel of equal or higher class, without change of cost of accommodation. Thus JSC "BookingService" immediately informs the client on the made replacement.
- Cost and payment
- Cost of services in the ordered service is defined according to the prices specified on a site at the moment of registration of the demand by the client.
- Room reservation of hotels is carried out on the terms of 100 % of an advance payment which the client spends after preliminary acknowledgement of booking by the operator.
- Possible forms and conditions of payment of services:
- Payment by cash or credit card at office of JSC "BookingService"
- Payment by cash to the courier of JSC "BookingService"
- Payment by the Notice through local branch of SberBank
- On-line payment by a credit card
- On-line payment by electronic payment.
- The client should inform in due time the operator "BookingService" on the made payment. In case acknowledgement of payment of services in due time does not act, the operator "BookingService" has the right to cancel the made booking.
- The responsibility of the parties
- JSC "BookingService" bears the responsibility for a material damage, caused to the client owing to lacks given services, by way of and the volume stipulated by the legislation of the Russian Federation, except for cases when infringement of the rights of the client has occured owing to force majeure circumstances.
- The client bears the responsibility for performance of the obligations to JSC "BookingService" and also for damaging JSC "BookingService" both a material damage, and damage of its business reputation.
- The person who issued and has sent the Application for booking, represents interests of all tourists brought in the Application for booking, bears the responsibility before JSC "BookingService" for correctness informed in the Application for booking of data about tourists, for performance by all tourists of all above-stated obligations, including obligations on payment of services and penalties in default from the ordered service.
- At refusal of the client of the paid booking, JSC "BookingService" returns to the client full cost of the ordered services minus the penalty. Payment of the penalty is made by the client at cancellation of the order or modification in the order for individual tourists less than 24 hours prior to a checkout time of date of settling in hotel (12:00) (! Annulment not less than for 24 hours it is established for the usual period, for the exhibition period, time for which is made annulment without the penalty it is necessary to specify in addition in company BookingService), and also at a non-arrival of the client to places of the beginning of consumption of the ordered services in target dates. The size of the penalty is understood as cost of all ordered at JSC "BookingService" the services falling the first day of service. Conditions of the penalty at refusal of booking for group of tourists it is defined by Contract JSC "BookingService" with corresponding hotel.
- The parties are relieved from the responsibility under the obligations in case of approach of force majeure circumstances (force majeur), such as earthquake, flooding, fires, typhoons, hurricanes, snow drifts, military actions, mass diseases, strikes, change of visa modes of the CIS countries and Baltics, and also restrictions of transportations, interdictions of trading operations with the separate countries owing to application of the international sanctions and other events, not dependent on will of the parties. At approach of such circumstances each of the parties is obliged to inform on it other party in as much as possible short term.
- Claims
- In case of occurrence of claims from the client during granting service, the client should issue in writing the claim and assure it at the representative of hotel. Documentary confirmed claim is transferred in JSC “BookingService”. If the reason which has caused the claim, on a place to eliminate it was not possible, the client should address in writing to Open Company JSC "BookingService " within 20 days from the moment of the termination of using by the ordered services. JSC “BookingService” accepts claims only with the resolution of the representative of hotel on impossibility of satisfaction of the claim on a place. Within 10 working days JSC “BookingService” or compensates losses of the client, or will give to it the written proved refusal.
- In any case, the size of losses of the client who is a subject compensation JSC “BookingService”, cannot exceed 100 % of cost got, but not given services.
- The client has the right to solve dispute with JSC “BookingService” in court by way of, established by the legislation of the Russian Federation.
