1. General Conditions BookingMoscow is a system of booking Moscow hotels and transfers in Moscow. The BookingMoscow website is owned and managed by the Svoy Travel, Ltd. Travel agency (Licence TD N 0020721).
1.1
All bookings processed through BookingMoscow are effected on the basis of the contracts made between Svoy Travel, Ltd. and Moscow hotels and transport companies. 1.2
Room bookings are effected in accordance with the terms and conditions ascertained by the hotel concerned. 1.3
All the prices on BookingMoscow are quoted in standard units, whilst payments shall be made in Russian rubles at the exchange rate determined by the hotel on the day of payment. 1.4
All the prices include VAT. 1.5
All the prices on BookingMoscow are valid for individual tourists.
2. Moscow hotel booking
2.1
Moscow hotel bookings are effected on the basis of a properly completed and sent reservation form or a telephone, e-mail or otherwise received order. 2.2 Preliminary booking confirmation shall be made by a BookingMoscow operator in the stated in the reservation form manner within a maximum 24 hour of receipt of the reservation request, except during weekends and official holidays. Reservation forms sent at weekends or on official holidays will be proceeded on the first working day following the day of request. 2.3
In exceptional cases BookingMoscow reserves the right to change th epreliminary booked hotel for another Moscow hotel of an equal or higher category, without price change. In such cases BookingMoscow shall immediately advise the client of the change made.
3. Prices and Payment terms
3.1
Reservation service cost corresponds to the prices indicated on BookingMoscow on the day of reservation. 3.2
All confirmed reservations require a 100% prepayment made soon after the preliminary confirmation. 3.3
Accepted forms and conditions of payment: - Payment by cash or by credit card in the BookingMoscow office - Payment by cash to the BookingMoscow courier - On-line payment by credit card 3.4
The client shall duly advise a BookingMoscow operator of the payment made. Should the payment confirmation not be effected in time, a BookingMoscow operator has the right to cancel the reservation.
4. Responsibilities
4.1
Svoy Travel, Ltd. Is held responsible for the pecuniary damages caused to the client because of the service deficiency as provided by Russian Law, except the cases of force-major. 4.2
The client is held responsible if he/she fails to carry out his/her obligations, or causes pecuniary damages to Svoy Travel, Ltd, or undermines the business reputation of Svoy Travel, Ltd. 4.3
The client, who makes the reservation, acts also on behalf of all other persons named in the application, and is held responsible for the correctness of relevant information and also for the performance of their contractual obligations (including payments and cancellation charges) as for his/her own. 4.4
In the event of the client canceling his/her tour reservation, Svoy Travel, Ltd. shall refund the sum of the payment with the exception of the cancellation charges. The cancellation fee shall be equal to the accommodation charge for one night and the cost of all the services for the first 24 hours reserved by Svoy Travel, Ltd. All cancellations made less than 48 hours before the arrival date will incur a charge. In the event of the client not arriving the cancellation charge will also apply. 4.5
On receiving a writing request to discontinue the Svoy Travel, Ltd. services, the sum, which is not to exceed the unused accommodation and meals charge starting from the day next to the end of service, can be refunded. 4.6
Both the parties to be released from their obligations in the event of any circumstances of force-majeur, namely: earthquake, flood, fire, typhoon, hurricane, snow-drift, war, military operations of any character, mass illnesses, strikes, changes of visa regime for the CIS and Baltic states, prohibitions of trade with any states in view of international sanctions or any other circumstances beyond the control of the parties. The party for whom it became impossible to meet its obligations shall immediately advise the other party of the circumstances preventing the fulfillment of its obligations.
5. Claims and Arbitration
5.1
All claims, which may arise on the part of the client, shall be submitted in writing and signed by a Moscow hotel representative. The registered claims should be forwarded to Svoy Trael, Ltd. If not settled during the stay, the written claim shall be sent to Svoy Travel, Ltd. no later than 20 days after the end of the Services. Svoy Travel, Ltd. will only accept claims with the note of an official Moscow hotel representative confirming the impossibility to settle the claim in the hotel. Within 10 working days Svoy Travel, Ltd. shall either refund the client's expenses or present a substantiated refusal in writing. 5.2
In any case, the expenses to be refunded by Svoy Travel, Ltd. shall not exceed 100% of the service, which was paid for but not supplied. 5.3
The client has always the right to refer for settlement of all disputes and differences, which may arise, to the court of jurisdiction and have them mediated in accordance with Russian Law.
